How a Consumer Proposal works with BNA

Review your financial situation
Your initial consultation is free and confidential. We review your income, living costs, assets, and debts, then explain whether a Consumer Proposal may be appropriate for your situation.

Build a plan that fits
We shape the offer around what you can afford and what creditors may accept. You see the monthly proposal payment and term (up to five years) before approving anything.
03
File and start protection
When you sign, your LIT files the Consumer Proposal. Protection starts. Interest on included debts freezes, and most collection calls, wage garnishments, and lawsuits stop.

Give creditors 45 days
We send your proposal to your unsecured creditors, including banks, credit card companies, and the Canada Revenue Agency. They have 45 days to review it. You do not deal with them—we do.

The vote
Creditors review the proposal based on the value of their proven claims. If a vote is required, approval depends on a majority in dollar value of the claims voting. Once accepted, the proposal becomes binding on the included unsecured creditors.

The plan in motion
Once the proposal is accepted, you make the agreed payments through BNA. We distribute the funds to your creditors, and you complete two required financial counselling sessions during the proposal.

The remaining debt is cleared
Once you complete the required payments and counselling sessions, BNA issues a Certificate of Full Performance. You are then legally released from the remaining balances of the unsecured debts included in the proposal, subject to applicable exceptions.

Can I file a Consumer Proposal myself?

No. Only a Licensed Insolvency Trustee (LIT) can file and manage a Consumer Proposal under the Bankruptcy and Insolvency Act. At BNA, your LIT along with their team reviews your financial situation, prepares the offer, files it, and deals with your unsecured creditors.

What happens if creditors reject my proposal?

A rejection does not end the conversation. Creditors may suggest different terms, and we can revise the offer with your approval. If a meeting is held, a majority in dollar value of the claims voting must agree.

Will I lose assets in a Consumer Proposal?

Usually, no. Unlike personal bankruptcy, a Consumer Proposal normally lets you keep your assets. In BC, the exemption amounts used in the bankruptcy comparison include $4,000 in household goods, $5,000 for one vehicle, and $10,000 in work tools. Home equity protection is $12,000 in the Metro Vancouver Regional District and Capital (Victoria) Regional District, or $9,000 elsewhere in British Columbia.

Does a Consumer Proposal include secured debts?

Not usually. A proposal may reduce credit card debt and income tax debt. It does not change a mortgage or car loan secured by the asset. Keep those payments current. Secured creditors may still act if you fall behind. A proposal alone cannot stop mortgage foreclosure.

Will a Consumer Proposal affect my credit score?

Yes. A Consumer Proposal appears on your credit report and affects your credit rating. Equifax and TransUnion remove it three years after you pay the included debts or six years after signing, whichever comes first. You can take steps to rebuild credit while the proposal is active.

How does a Consumer Proposal compare to other options?

A debt consolidation loan replaces debts with new credit and interest. A debt management plan usually repays the principal in full. A Consumer Proposal may reduce included unsecured debts, stop further interest, and provide legal protection.
